The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Eye Institute (NEI), intends to procure, on a sole source basis, software maintenance and technical support services for NextGen software products installed and in use in the NEI Clinical Center from NextGen Healthcare, Inc. The acquisition will be processed under FAR Part 12, utilizing simplified procedures, with competition restricted as only NextGen Healthcare, Inc. possesses the proprietary technical knowledge, source code access, and intellectual property rights needed for the required software maintenance and support. While third-party resellers may distribute certain baseline versions, only the original equipment manufacturer offers specialized support and ongoing updates for the proprietary application software deployed at NIH/NEI.
